Terms of Service

GENERAL NOTICE

These are the Terms of Service that govern your access and use of Tithify and the services we offer. Use of Tithify services requires your agreement to be bound by the terms outlined in this Agreement. This "Agreement" is a legal agreement between you/your ministry and Tithify. Before a new ministry/organization can be registered, agreement and consent must be given by the administrator (user account that is registering the ministry/organization). For a ministry/organization that is already registered, all newly created staff accounts (upon first login), must agree/provide consent to the Terms of Service.

YOU AGREE THAT YOUR USE OF OUR SERVICE ACKNOWLEDGES THAT YOU HAVE READ AND UNDERSTAND THIS AGREEMENT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITION AND THE SPECIFIC TERMS AND CONDITIONS OF SERVICES WITHIN TITHIFY.

DEFINITIONS

Organization: A term that refers to the entity registered within Tithify. This can include churches, ministries, faith-based organizations, missions, non-profit or other ministry based entity.
You: A representative of the organization within Tithify. Use of "you" or "You" implies "Your and the organization you represent".
Service/Services: The free and/or paid services offered by Tithify at sites/subdomains hosted at Tithify.com (to include www.tithify.com, services.tithify.com, mygiving.tithify.com -- and all other subdomains hosted at Tithify.com).
Tithify Web Portal: The Tithify website -- hosted via the top level domain tithify.com or any subdomain of tithify.com.

Tithify is a SaaS (Software as a Service) product that is owned by Vineyard Technologies, LLC., a Virginia Corporation. Unless otherwise indicated in this Agreement, all communications with Tithify should be directed to Tithify via e-mail at info@tithify.com or by mail to Tithify/Vineyard Technologies, LLC, P.O. Box 4778, Midlothian, VA 23112.

REGISTRATION

Registration is required to use the services offered by Tithify. During registration, Tithify will ask for information to help identify your identity and organization. You agree to provide complete and accurate information during the registration process, and you agree not to provide any registration information that is false, misleading or incorrect. You also agree to update your profile information when your information changes.

If at any time we have any reason to believe that any of your registration information is inaccurate, untrue, incomplete or otherwise incorrect, we reserve the right to terminate this Agreement.

Additionally, we may refuse to grant you a specific username that may be misconstrued as another individual, is illegal, protected by trademark or other proprietary rights law, is offensive or vulgar, may cause harm or confusion to others, or any other instance as determined by our sole discretion.

USER ACESS TO SERVICES

Only one individual can access Tithify using a specific user account. A user account is defined a unique user name/password combination for accessing the Tithify site. We want you to use separate permissions -- as this allows for a more secure method of managing resources (each user account can have a separate set of roles and/or permissions). In addition, this allows an audit trail to be established on a per-user basis. The audit trail allows ministry administrators and user accounts with the appropriate role/permission to view a list of actions performed by a user account. Remember: there is no charge to create additional user accounts for ministry staff.

PAYMENT FOR SERVICES

Online payment via debit/credit card is the only method used to subscribe to Tithify Services. Payment is due on a monthly basis (one month from the date of full registration). When registering an organization on Tithify, we do not ask for a debit/credit card. During this time, your ministry/organization will have a 30 day trial access to Tithify. At the end of the trial period, you will be asked whether you would like to continuing using Tithify (at which point, we will ask for a debit/credit card) or cancel your trial use of our service. If you choose to join the Tithify family and user our service, your ministry/organization will be billed, one month later, using the debit/credit card used when fully registering the ministry. Subsequent payments will be debited in monthly intervals.

Tithify subscription prices are based on the number of people/organizations stored within your Tithify ministry database. Tithify uses a Level 1 PCI DSS Certified Recurring Billing Provider. Offline payments via check, money order, or invoice/purchase order are not accepted. Specific prices are governed by the subscription tier listed on the Tithify website.

When the number of person/organization records for an organization moves upward, into a new subscription tier, the ministry will be billed at the rate of the new tier. All subscription payments will be applied to the same debit/credit card. If a new debit/credit card is used, all subsequent payments will be billed to the new debit/credit card. Please note that if your organization's subscription tier is lowered (due to the removal of previously added people/organization records) OR if you cancel your organization's use of our service, there is no proration of remaining funds for the month.

If your organization's person/organizational record count drops below a subscription tier, your organization will automatically be placed in the lower subscription tier. Your subscription will automatically be charged the price associated with the lower subscription tier during the next billing cycle and each billing period after that. No refund, under any circumstances, will be made for an organization that is automatically placed in a lower tier based on partial use of a subscription tier.

You agree to provide Tithify with a valid debit/credit card and agree to keep accurate and complete personal information up-to-date. If you want to use a different debit/credit card, or if there is a change in the debit/credit card information or expiration date, you must update the information within Tithify. Failure to comply may result in suspension or termination of access to Services.

To cancel your organization's subscription to Tithify, you must terminate your use of our Services as outlined in the TERMINATION section of this Agreement.

Tithify, at its discretion, will assess an additional 1.5% (or the highest amount allowed by law) per month late charge if your payment is more than 45 days past due. Past due amounts are due immediately. For past due amounts, Tithify reserves the right to suspend your organization's access to our Service until the account is made current. You/your organization will also be responsible for any fees, including reasonable attorney and collection fees, that Tithify may incur in the collection process. You also agree that you/your organization will be billed for and will pay any outstanding balances if you cancel the Service, or the Services are terminated.

Should you have a billing discrepancy, you agree to contact Tithify by phone at (888) 56-FAITH (888-563-2484) within 30 days after said discrepancy appears on your statement. If you do not bring such a discrepancy to the attention of Tithify staff within 30 days, you agree to waive your right to dispute such discrepancies. If a discrepancy is found, Tithify will provide a refund in the form of electronic disbursement to the debit/credit card saved via the Tithify website.

Tithify reserves the right to change the amount of fees or charges for Services, and to change the billing cycle. We also reserve the right to change the types of Services offered for specific subscription tiers, providing notice of such changes to registered users via their designated primary e-mail account or posted as a message to your Tithify Inbox within the Tithify website.

SECURITY / DATA SAFEGUARDS

Tithify takes great care to safeguard your ministry data. Your debit/credit card, personal information, billing information and all other information are stored with security in mind.

To protect the security of your credit card information, we employ industry-standard TLS/SSL technology. Your debit/credit card number is not stored on Tithify servers. Your debit/credit card number is stored and accessed via a Third Party, Level 1 PCI Compliant Payment Gateway. All communications with the gateway is done via TLS/SSL and is secure.

Payment Gateways/Merchant services used by Tithify operate their own services, and they are responsible for their own terms of service and privacy policies. Payment Gateways/Merchant Services used by Tithify are solely responsible for how they use the information they acquire from or about you/your organization. A link to the terms of service for the Payment Gateway (used to process debit/credit card donations for your organization's constituents) will be provided when setting up your organization's funding account.

If you believe someone has accessed your account within Tithify without your authorization, you must contact us via telephone at (888) 56-FAITH (888-563-2484) immediately.

TERMINATION

When you submit a cancellation/deletion of service request to Tithify via the web portal, your ministry/organization and all associated data will be locked and placed in a "Pending Delete" status. All access to Tithify services will be suspended during this time. An organization will be in a "Pending Delete" status for 14 days. During this time, your ministry/organization can be reinstated by having the administrator account, created during registration, perform a "Restore" on the ministry/organization. If a "Restore" is not made within 14 days, all organizational data will be purged from Tithify servers with an exception of chat logs, survey data, bug/error logs, feedback messages and forum posts made by organizational user accounts during the use of the service. An organization and any data associated with that organization cannot be reinstated once it has been purged from the system.

Cancellation/Deletion of the subscription will signify a termination of all Tithify services. You may cancel the your subscription to Tithify services, at any time. No refund will be given for a partially used month of Tithify services. If you cancel the service, you may not transfer the balance of any unused time on your account to another organization subscription or user account.

Tithify may terminate this Agreement, and your access to its Services if, in our judgment, you violate any part of this Agreement or any sub-agreement.

Upon termination of this Agreement, by you or Tithify, you shall immediately discontinue use of the Services.

ABUSE OF SYSTEM

Ministries/organizations are not allowed to abuse Tithify services and/or servers. Abuse of Tithify services and/or servers is defined as:

Creating scripts to automate interactions with Tithify services and/or servers. Scripts may be ran against the officially sanctioned and fully released Tithify Public API. Each ministry/organization must be granted explicit permission to use, consume and interface with the official released Tithify Public API. In the case of using/consuming the Tithify Public API, we reserve the right to throttle incoming API calls.
Scan or perform penetration testing on Tithify services and servers, to include the officially sanctioned and fully released Tithify Public API
Attempt to circumvent Tithify security and validation procedures and protocols against Tithify services and servers, to include the officially sanctioned and fully released Tithify Public API.

In addition, ministries/organizations are not allowed to hire, employ, contract and/or solicit other individuals and/or businesses to abuse Tithify services and servers, to include the officially sanctioned and fully released Tithify Public API.

E-MAIL NOTIFICATION FOR REGISTRANTS

Tithify uses e-mail as a means of contacting registered users about billing, fees, renewals, changes in services, upgrades, and accessing content. You agree, as a registrant, that Tithify may send service-specific, feature-specific and system-specific e-mails to the primary e-mail address that you provide with your ministry/organization registration. As Tithify e-mails are critical and necessary, in terms of site operation, you cannot opt-out of these e-mails.

If you do not want to receive service-specific, feature-specific and system-specific e-mails from Tithify, you must cancel your subscription to Tithify services as provided in the TERMINATION section of this Agreement.

Tithify holds your e-mail and related personal information in strict confidence in accordance with our Privacy Policy. Tithify does not sell or rent lists of registered ministries/organizations or associated data elements such as member lists and user accounts. You will not receive SPAM or other unsolicited e-mails from Tithify beyond the e-mails outlined in the E-MAIL NOTIFICATION FOR REGISTRANTS section.

CONTENT LICENSE AND REQUIREMENTS

The Tithify name, Tithify site/web portal, Tithify logo, graphics, database design schemas and source code is our property and copyright, and/or the property of the authors, content partners and licensors, and is protected by copyright and intellectual property laws. The data stored within our system and database, specific to your ministry/organization, belongs to your ministry/organization. This includes the records related to people, donations, membership/record categories, pledges and other data specific to your ministry/organization. Shared data, such as system logs, forum posts, feedback messages, login history, system reference data and other data that is used to support all organizations within Tithify, does not belong to your ministry/organization. In addition, details on how your organization data is stored in Tithify databases (the schema) is our property. As such, we may need to modify the database schema to support enhanced functionality. To support new features, we update the schema on a continuous basis to provide greater functionality to all ministries/organizations. We will handle all transformation and conversion of ministry/organization data into new formats to support updated database schemas. This is seamless to your ministry/organization. You may display or print the content available through Tithify for your organizational use only. Some materials may not be available for non-commercial training purposes. For more information, e-mail info@tithify.com. You agree to use the content and services within Tithify in a manner that complies with all applicable laws in the jurisdictions in which you use them, including application restrictions on copyright and intellectual property rights. Tithify user accounts may not be shared under any circumstance. We do not charge you/your organization for additional user accounts. Your ministry/organization is permitted to create additional accounts, as needed, with no charge to your subscription premiums.

LIMITATION OF LIABILITY

UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL TITHIFY, VINEYARD TECHNOLOGIES, LLC, ITS AGENTS, CLIENTS, SERVANTS, ASSIGNS, OFFICERS AND EMPLOYEES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, TITHIFY SERVICES OR MATERIALS OR FUNCTIONS ON ANY SUCH SITE or SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT [INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE], OR OTHERWISE) EXCEED THE AMOUNT ACTUALLY PAID BY YOU, IF ANY, FOR ACCESSING TITHIFY AND ITS SERVICES.

RIGHT TO TERMINATE OR MODIFY AGREEMENT, SERVICES

Tithify may modify or terminate the terms of the Agreement of Services, including but not limited to price, content, types of services, upon notice to the registrant. In the event of this change, you may terminate this Agreement and any services by Cancelling/Deleting your Organization Subscription on the Ministry Administration page within the Tithify web portal.

Such notice of a change or termination of this Agreement of Services may be provided by e-mail, by notification banner or highlighted element on the Tithify web portal, or by by posting the changes or notice of changes in the System Announcement Inbox of the Tithify web portal.

PRIVACY / GENERAL OVERVIEW

Personal information you provide to Tithify is governed by the Tithify Privacy Policy. Your acknowledgement of the privacy policy, indicates your acceptance of the terms of the Tithify Privacy Policy. The Privacy Policy details how personal and ministry/organization data is treated and governs our actions in reference to this data.

CHATS, FORUMS, FEEDBACK MESSAGES AND OTHER ONLINE COMMUNICATION

Tithify may choose to host a variety of online instant and archived communications, including, but not limited to, chat, hosted discussions, message boards (forums) and e-mail. Each of these Services may include its own Terms of Service with specific rules, regulations and guidelines for use of said service. Participation in any of these Services binds the user to this Agreement and the Terms of Service of said Service.

Such services are intended to serve as discussion and information centers for Tithify registrants. Information provided within may be provided by said registrants, contributors, staff or others connected within Tithify, and its parent company, Vineyard Technologies, LLC., some of whom may use anonymous screen names. Messages or statements posted by individuals within these services may be deceptive, incorrect, not factual, misleading or otherwise false, intentionally or unintentionally. We do not endorse nor are we responsible for any opinions, advice, content, omissions, hyperlinks, images, articles, information or statements made or displayed within these Services by third parties. Under no circumstances are we, our partners, contributors, suppliers, or their agents, liable for any loss or damage caused by your reliance or beliefs of information contained within these discussion-type Services. The opinions and information expressed within these Services is solely that of the poster, and does not reflect that of Tithify, its parent company Vineyard Technologies, LLC. or any of its affiliates or partners. While we attempt to respond to specific issues and complaints that are brought to our attention, we have no obligation to monitor the content of these areas.

You acknowledge and agree we have the right to monitor any transmission made through a Tithify Service, including, but not limited to, chat and forums, and have the right to alter and remove any materials without limitation, to remove any user and terminate this Agreement for any real or perceived violation of this Agreement or that of a specific service.

We will disclose such materials and circumstances surrounding its transmission to any third party, including law enforcement and legal officials, in order to operate the Tithify site and services properly, to protect ourselves, our sponsors, and our registrants and visitors.

NOTICE SPECIFIC TO MATERIALS AND LINKS AVAILABLE ON THIS WEBSITE

Use of any copyrighted materials, including but not limited to the name Tithify, the name Vineyard Technologies, text, photos, graphics, logo and sounds, is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.

Elements of Tithify and Vineyard Technologies, LLC are protected by trade dress and other laws and may not be copied or imitated in whole or in part. No logo, graphic, sound or image from any Vineyard Technologies, LLC site and/or service may be copied or retransmitted unless expressly permitted by Tithify and Vineyard Technologies, LLC. Tithify and Vineyard Technologies, LLC reserve the right to revoke such permission without notice.

Any dispute or lawsuit against Tithify or Vineyard Technologies, LLC. which concerns this Agreement or which arises in any manner out of the use or operation of the Tithify web portal and/or use of Tithify services shall be brought solely in a state or Federal court in and for Richmond, VA, unless Tithify or Vineyard Technologies, LLC consents in writing to a different court or forum. EACH PARTY WAIVES ITS RIGHT TO A TRIAL BY JURY IN ANY SUCH DISPUTE OR LAWSUIT.

Privacy Policy

INFORMATION COLLECTION AND USE

Your ministry data belongs to your ministry. Tithify will not sell or rent this information to others in any way and will only share limited information when legally required to do so. Tithify collects information from users at several different points on our website. Information collected using the Tithify website includes ministry/organization information, organizational groups and committees, visitor information, member information, donations, user account information, user account preferences, credit card billing information associated with the ministry/organization, funding bank account information of the ministry/organization (if the ministry chooses to use Tithify to process debit/credit card donations) and other information specific to helping your ministry/organization manage your ministry data and resources. The information is stored in an enterprise database using a major cloud platform. User profile data and/or preferences may also be stored locally in cookies on a user's personal computer. Local cookie data is used by Tithify servers and is sent to and from such servers as part of routine communications that support our Services.

Tithify uses this information to:

Verify access rights to content and services.
To provide you with information about news, services and events.
To allow you to purchase additional services.
To provide you with advertising, promotions and special offers we feel you may be interested in based on content preferences and other information you provide to us.
To provide you with personalized content and services that may be helpful to your ministry/organization.
For license reporting, billing and assessment of ministry/organization and service levels.
To better understand how and which of our Services are used, traffic levels and patterns and what types of content and services are most popular with users of our services.

REGISTRATION

In order to use sections of our website, a user must first complete the registration form. During registration a user is required to basic ministry/organization information (such as organization/ministry name and description) and administrator information (such as name, desired user name and email address). This information is used to register the ministry/organization and create an initial administrator account for the ministry/organization within Tithify.

SUBSCRIPTION PAYMENTS FOR SERVICES

A debit/credit card is not required to start using our service. Upon registration, you will have 30 days to use our service. At the end of the trial, you will have the option of continuing use of our service (at which point, we will ask for a debit/credit card) or cancel your trial (at which point, any ministry data will be queued for deletion).

COOKIES

A cookie is a text file with pieces of data stored on the user's hard drive containing information about the user, including but not limited to, user site preferences. Once the user closes their browser, the cookie simply terminates. If a user rejects the cookie, the user will be limited in accessing some areas of functionality within Tithify. Cookies can also enable us to track and target the interests of our users to enhance the experience on our site.

LOG FILES

We use IP addresses to analyze trends and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information.

SHARING

We use a recurring billing company company to bill your ministry/organization for monthly subscription payments. We, securely, share the minimum amount of information necessary to create a billing profile for your ministry/organization.
We use a Level 1 PCI Compliant Payment Gateway/Marketplace provider to process debit/credit card donations to your ministry/organization. Please note that the ministry administrator or a user with the appropriate permission, must give us explicit permission to do so. If permission is given, we will collect and share minimal information regarding your ministry/organization to setup a billing profile. For each debit/credit card donation, Tithify requests typical debit/credit card information (name, card number, expiration month, expiration year, CVV/CID/CVC code). Tithify passes this information, securely, to the payments provider. When this information is securely passed to the payments provider, we receive a unique token that is tied to the debit/credit card. Tithify stores this token as a pointer. Tithify NEVER stores the full debit/credit card number or the CVV/CID/CVC Code. With respect to the card number, Tithify only stores an encrypted, masked representation of the last 4 digits of the card number to help staff and contributors in differentiating debit/credit cards and transactions.
We use email providers to facilitate sending emails to Tithify users regarding new services, features, security notifications (i.e. password change and reset, debit/credit card update, profile information change, etc.) and planned maintenance. To facilitate this, we share the email address (and potentially, the name) of Tithify users with the email provider for the sole purposes of sending email messages to one or more targeted users or mass "email blast" via mail group.
We will only share limited ministry data if legally required to do so via court order from a federal/state recognized court within the United States.

SURVEYS

From time-to-time Tithify may request information from users via surveys. Participation in these surveys is completely voluntary. Survey information will be used for purposes of monitoring or improving the use and satisfaction of Tithify, as well as, compile aggregated demographic information.

SERVICE REFERRAL

If a user elects to use our referral service for informing a friend and/or colleague about our service, we will ask for the individual's name and email address. Tithify will automatically send the individual a one-time email inviting them to visit the site. Tithify uses this information for the sole purpose of sharing the benefits of our service with the referred individual.

SECURITY

Tithify takes every precaution to protect your user and ministry data. For safety and security, all pages within Tithify are encrypted during the transmission process using Industry Standard SSL/TLS. In addition, the enterprise database that stores your minstry data implements encryption at rest. Database backups are encrypted and stored within a secondary encrypted container.

SITE AND SERVICE UPDATES

Tithify periodically sends service, feature and maintenance announcements. Users cannot unsubscribe from these announcements, as they contain important information about Tithify. We communicate with the user to provide additional information about service updates, newly released features and plans for scheduled updates and maintenance.

CORRECTION/MODIFICATION OF PERSONAL INFORMATION

If a user's personally identifiable information changes (such as your name, email address or zip code), we will endeavor to provide a way to correct and/or update that user's personal data provided to us. This can usually be done via the User Profile or Staff Administration page (the latter only accessible if the user has appropriate permission) within Tithify.

NOTIFICATION OF CHANGES

If we decide to change our privacy policy, we will send an email to every user's Tithify inbox (accessible within Tithify). Every user will have 14 days to review the updated privacy policy before it must be acknowledged. At the end of the elapsed time, users who have not acknowledged the privacy policy will be required to do so before access to Tithify can be restored. We want every user to be aware of what information we collect, how we use it, and under circumstances, if any, we disclose it.
